9. Indemnity

All users should agree to indemnify and keep indemnified eGarden from all liabilities, claims, losses and expenses, including any legal costs on a full indemnity basis arising out of the user’s use of: 

  1. User’s misuse of the Website and the services provided
     
  2. Any breach of these Terms and Conditions by users
     
  3. Any intellectual property right or proprietary right infringement claim made by third party against eGarden.
 
 
All the term of sale covers the presumptions under Electronic Transactions Act 1998 (“ETA”).
 
  1. eGarden and all users agree that all agreements, notices, disclosures and other communications in electronic form constitutes as a written document.
     
  2. All users should undertake not to dispute or challenge the validity or enforceability of this term of sale on the grounds that it is not a written document.
     
  3. eGarden and all users hereby waive any such right eGarden may have at law.
 
 
All the term of sale covers the presumptions under Electronic Transactions Act 1998 (“ETA”).
  
  1. Customer agrees to pay eGarden the total amount set forth in the contract of sale and any other mutually agreed charges that stated on the payment page.
     
  2. All transactions that made for orders of products and/or services are effected in Malaysia and in respect of local deliveries only.
     
  3. All transactions are to be charged and payable in Ringgit Malaysia (RM), unless otherwise stated in the confirmation order.
 
 
The failure of eGarden to implement or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
